Understanding Unfair Dismissal Under Namibian Labour Law
What employers and employees need to know about the grounds for dismissal, procedural fairness, and recourse through the Labour Court.
The Labour Act 11 of 2007 governs the employment relationship in Namibia and sets out clear requirements for a lawful dismissal. Both substantive and procedural fairness must be satisfied.
Substantive Fairness requires that there be a valid and fair reason for the dismissal, whether misconduct, incapacity, or operational requirements (retrenchment).
Procedural Fairness requires that the employee be given proper notice of the allegations, an opportunity to be heard, and a decision communicated in writing.
Failure on either ground exposes the employer to a finding of unfair dismissal at the Office of the Labour Commissioner or the Labour Court, where reinstatement or compensation may be ordered.
Employees who believe they have been unfairly dismissed must refer the dispute within a prescribed period. Time limits are strictly enforced.
