Divorce in Namibia: What You Need to Know

Divorce proceedings in Namibia are instituted in the High Court. The sole ground for divorce is irretrievable breakdown of the marriage.
Division of Assets depends on the marital regime: - In community of property: the joint estate is divided equally - Out of community with accrual: each spouse shares in the growth of the other's estate - Out of community without accrual: each spouse retains their own assets
Maintenance: Either spouse may claim maintenance, assessed by reference to needs and means. Child maintenance is assessed according to the best interests of the child and the parents' financial positions.
Custody and Access: The court's paramount consideration is the best interests of the minor children. Joint custody arrangements are increasingly common in Namibia.
The Process: An uncontested divorce can be finalised relatively quickly. Contested divorces, particularly those involving substantial assets or custody disputes, may take considerably longer.
