An antenuptial contract (ANC) is a legal agreement concluded before marriage that regulates the financial consequences of the marriage. In Namibia, couples who wish to exclude the default matrimonial property system must sign an ANC before a notary public and have it properly registered. In establishing whether or not a marriage between parties has been contracted in or out of community of property, the courts rely on said interpretation in decided case law, such as Mulenamaswe v Mulenamaswe (I 2808/2011) [2013] NACMD 275(9 October 2013).
