Buying Property in Namibia: A Legal Guide

Acquiring immovable property in Namibia involves several legal stages, each with its own requirements and risks. Understanding the process protects buyers and sellers alike.

Offer to Purchase: The process begins with a written offer to purchase, which becomes a binding contract once accepted. Conditions such as bond approval or sale of another property should be clearly stated.

Due Diligence: Before transfer, conduct a deeds search to confirm ownership, check for bonds or servitudes registered against the property, and verify that rates and taxes are paid up.

Transfer: Transfer is effected by a conveyancer at the Deeds Office. Transfer duty is payable to the Namibia Revenue Agency on properties above the threshold value.

Registration: Ownership passes upon registration at the Deeds Office, not upon signing the agreement.
